What are the penalties for driving while suspended or revoked in New Jersey?

There is a wide range of penalties for these offenses, depending upon how may prior convictions there are for this offense, and depending upon the reason for the suspension.

If it is a first offense, there is a mandatory fine of $500 and up to six months loss of drivers license.

For as second offense, a mandatory $750 fine and up to six months loss of drivers license. Also, the offender must be sentenced to jail for a period of between 1 and 5 days.

For a third or subsequent offense, a mandatory $1,000 fine, up to six months loss of drivers license. Also, the offender must be sentence to a jail term of 10 days.

Are there any enhanced penalties associated with this offense?

Yes. If the reason for the suspension was driving while intoxicated or driving without insurance, then there is an addition minimum 10 days in jail, up to 90 days in jail, additional 1 to 2 year loss of license, and an additional $500 fine.

If the reason for the suspension is failure to pay insurance surcharges, and the surcharges are not paid by the time you get to court, you will be fined an additional $3,000.

If someone other than yourself is injured, you must be sentenced to 45 days in jail.
